Blocked Drain Responsibility in Chesham | Who Actually Pays

Your drain is blocked. You want to know who pays. That's the whole question, and it's a fair one because the answer trips up a lot of Chesham homeowners every year.

Let me give you the short version first, then explain why it's slightly more complicated on older Bucks properties.

The Basic Rule: Your Property, Your Problem, Up to a Point

Anything inside your boundary, serving only your property, is yours. A blocked toilet, a slow kitchen drain, a gully that stinks on a Botley estate terrace. All yours. Thames Water won't touch it, and if you ring them they'll tell you politely to go away.

Once a drain leaves your boundary and connects to a shared sewer that serves two or more properties, it becomes a public sewer. Thames Water own it, maintain it, and are responsible for clearing it. That boundary is called the lateral drain, and it matters enormously.

Where It Gets Messy in Chesham

The 2011 Water Industry Act transferred private shared sewers into Thames Water's ownership. Before that, you and your neighbour jointly owned the bit of pipe running between your houses and the main sewer. Nightmare stuff. That changed over a decade ago, but here's what hasn't changed: plenty of older Chesham streets still have drainage that doesn't behave like the textbook says it should.

I had a job on a 1930s semi up near Great Hivings last spring. The homeowner had been told by a call centre that it was Thames Water's problem. They'd been waiting three weeks. I put a camera down, found the blockage sitting four metres inside the boundary, entirely within the owner's lateral drain. Nothing to do with Thames Water at all. Three weeks wasted.

Older properties in Newtown, Waterside, and around Lye Green are particularly prone to this confusion. The drainage was laid before any of the current rules existed, and the pipe runs don't always follow the logical path you'd expect from the street layout.

How to Work Out Where You Stand

Thames Water has a sewer map you can request, or their online map tool gives a rough picture. But honestly, the map and reality don't always match on older HP5 streets. The only way to know for certain is a CCTV drain survey. A camera goes in, you see exactly where the blockage sits, and you know whose bill it is.

I'd rather tell a homeowner it's Thames Water's issue and save them money than charge them for a job that isn't theirs. That's just how it should work.

The Shared Drain Trap

Here's one that catches landlords especially. You own a rental on Chessmount or Codmore Hill. Your tenant reports a blocked drain. You assume it's the tenant's problem because they live there. It isn't necessarily.

If the drain runs shared to a neighbouring property before reaching the sewer, and the blockage is in that shared section outside your boundary, Thames Water are responsible. If it's inside the boundary but shared between two of your own flats in a converted house, that's yours again. The permutations are dull but the financial difference isn't.

What Thames Water Actually Do

Call them on 0800 316 9800. They have a 24-hour line. If the blockage is on a public sewer they should attend, usually within a day for a total blockage. They'll jet the line and leave.

What they won't do is repair the sewer if it's collapsed or root-damaged. They'll clear it and then decide whether the repair is their liability. Sometimes they do the repair. Sometimes they drag their feet. If it's affecting your property and they're moving slowly, you're entitled to push.

When It's Clearly Yours

If it's any of these, don't bother ringing Thames Water:

• Single property blockage that doesn't affect neighbours
• Roots inside your own drainage run within the boundary
• A collapsed or cracked pipe in your garden
• A blocked gully in your driveway or yard
• Fat and grease build-up in a kitchen drain
